Internet Policy (Contract) for ServAsk’s Refer-a-Micro Program (“RAMP”)

ServAsk’s Refer-a-Micro Program (“RAMP”) is a limited time program that rewards customers and friends of micros (defined below) for successfully referring micros to ServAsk. To participate in RAMP, you must comply with all of the requirements specified in this policy.

Time Period of current RAMP:         April 12, 2006 - December 31st, 2006. 
Commission for successful referral: $15 USD.
Cost of each listing during RAMP:  $35 per listing per year; nonrefundable.

Definitions used for RAMP
A microbusiness (“micro”) is either an individual or a small business with 5 or less employees, who is currently offering services. The micro could also be selling product that is customized to customers’ specifications. For example, a quilter who sews custom quilts for her customers is a micro. For the sake of RAMP, the micro's services must be independent: this means that the micro's services may not be affiliated with a franchise, network marketing company, or any company with more than 5 employees.  For example, if the micro is an employee of a large company as a computer programmer, but also works as an independent contractor as a programmer for other companies, then she may qualify for RAMP.  An example of someone's services who do not qualify for RAMP is a tutor who only tutors as an employee of a large, national company.   

A successful referral occurs when ServAsk receives the designated payment for a micro’s listing AND the listing is approved by ServAsk for display to the public. The micro must become a member and enter at least one listing for its service. ServAsk reserves the right to reject and edit any listing that we feel is inappropriate or does not comply with our business policies. ServAsk may take up to 24 hours or more to review a listing after it is entered or altered. Each listing charge is non-refundable.

An active member of ServAsk is one who is a registered member of ServAsk and OPTs IN to receive occasional communications from ServAsk.com, mainly through email. Hence, an active member keeps a valid email address registered with ServAsk.com.

Eligibility for Commission
ALL of the following conditions must be met before you are eligible for a RAMP commission for a successful referral.

1. You must be an active member of ServAsk. Membership is free (though listings are subject to the above fee). You must remain an active member at least until the time the commission is paid. However, we ask that you keep your email address up-to-date in ServAsk so that we can send you occasional emails regarding ServAsk news.

2. You must participate in RAMP through the ServAsk.com website by completing the designated forms on the ServAsk.com website. Sending ServAsk names (such as via email) is NOT a valid form of participation in RAMP, and will not qualify you for a RAMP commission.

3. You must be 18 years or older.

4. You may not refer yourself.

5. You must have a pre-existing relationship with the micro. ServAsk prefers that you are a current or former customer of the micro. However, if you have a friend who is a micro, you may refer him/her. You may refer your customers, if they are also micros. If the micro does not verify a pre-existing relationship between itself and you, then you are not eligible for the commission, even if the micro successfully lists its services. The best way to ensure a successful match between the micro and you is for the micro to include your MemberID and Match Code after registering.

6. You must not illegally solicit nor spam people or businesses.

7. You may not refer a micro who has already entered a free listing in ServAsk prior to RAMP, because these micros are eligible for free listings throughout 2006.

8. You must be the first member to enter the contact information of the micro on ServAsk.com, and you must do so before the micro registers.

9. You may only receive one commission per micro, even if the micro pays for more than one listing.

10. ServAsk must accept a listing from the referred micro. If ServAsk rejects all of the listings that the referred micro entered, you are not eligible for any commission.

11. Because of IRS laws, you may not refer more than the number of micros that would allow you to receive $600 or more in commission, unless you receive prior approval from ServAsk.

12. Listings must only be made by the micro itself or its authorized representative. ServAsk reserves the sole discretion to determine whether a representative is authorized.

13. MemberID in ServAsk must be unique for each member.

14. You must agree that you are neither employed by ServAsk nor are operating as an independent contractor for ServAsk, unless you receive prior approval from ServAsk.

15. Your participation in this program must not violate local law.


Other Requirements and Rules
The following also apply to the RAMP program:

16. Upon a successful referral, ServAsk will send you the appropriate commission within 30 days. Your commission will be paid via PayPal, if you include your PayPal email address.  Otherwise, your commission will be paid by check.

17. ServAsk reserves the right to extend RAMP. If RAMP is extended for another period of time, ServAsk reserves the right to alter the listing fee as well as the commission amount, as well as any of the other RAMP rules.

18. ServAsk reserves the right to cancel your membership and participation in RAMP at any time for any reason.

19. All ratings and feedback you enter for micros are permanent. You are responsible for your own words. ServAsk does not evaluate feedback for accuracy or fairness and disclaims any responsibility for ratings and feedback left. You may not edit nor delete ratings and feedback at any point. We may allow, under extreme and rare circumstances, withholding of ratings and feedback, if both the micro and customer agree. Therefore, we strongly advise you to be very careful of your ratings and feedback. Stick to the facts. You may be held liable for your comments in a court of law by the injured party.

20. You may leave feedback for one type of service, even though the micro lists a different service. For example, you may have hired the micro to mow your lawn at one point, but now the micro is listing small engine repair services. Please specify for what service you hired the micro when you enter your feedback.

By participating in RAMP, you agree to be subject to all of the terms and conditions of RAMP, along with all other ServAsk Policies. ServAsk reserves the right to restrict or reject you from participating in RAMP if you fail to comply with any of the terms and conditions.
